Website Terms of Service

SkinWise, PLLC d/b/a SkinWise Dermatology

Last Updated: September 2, 2026

These Website Terms of Use (these “Terms,” also referred to as our “Terms of Service”) govern your access to and use of the website located at https://skinwisedermatology.com, together with any related online features we make available through it (collectively, the “Site”). The Site is operated by SkinWise, PLLC d/b/a SkinWise Dermatology (the “Practice,” “we,” “us,” or “our”).

Please read these Terms carefully. They include a disclaimer of warranties, a limitation of liability, an indemnification obligation, and a provision governing where disputes must be brought. They also explain what these Terms do not cover. In particular, they do not govern your protected health information or the professional health care services we provide. Information we collect through the Site is described in our Website Privacy Policy (the “Privacy Policy”), and your protected health information is governed by our Notice of Privacy Practices (the “Notice of Privacy Practices”).

  • Acceptance of Terms
      1. By accessing, browsing, or otherwise using the Site, you acknowledge that you have read and understood these Terms and agree to be bound by them and by our Privacy Policy, which is incorporated into these Terms by reference.
      2. If you access or use the Site on behalf of another person, you represent that you are authorized to accept these Terms on that person’s behalf, and you accept them both individually and on that person’s behalf.
      3. We may require you to affirmatively accept these Terms before you create an account, submit a form, request an appointment, or make a payment through the Site. Your acceptance and the version of these Terms you accepted may be recorded and retained.
  • No Medical Advice; No Physician-Patient Relationship
      1. The content on the Site, including service descriptions, articles, blog posts, frequently asked questions, images, and general health information, is provided for general informational and educational purposes only. It is not medical advice, diagnosis, or treatment, and it is not a substitute for consultation with a qualified health care provider who has evaluated you.
      2. No physician-patient relationship is created by your use of the Site, by your reading content on it, by your submission of an email or by any other communication you send through the Site. A physician-patient relationship with the Practice is established only when you have been accepted as a patient and receive services in the course of a properly established in-person or telehealth encounter.
      3. You should not delay seeking, disregard, or discontinue medical care because of anything you read on the Site. Always consult your own health care provider about a medical condition and before beginning, changing, or stopping any treatment.
      4. Individual results vary. Any images, testimonials, or descriptions of outcomes appearing on the Site are illustrative only and are not a promise, guarantee, or prediction of any particular result.
  • Medical Emergencies
      1. DO NOT USE THE SITE FOR MEDICAL EMERGENCIES. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 OR GO TO THE NEAREST EMERGENCY DEPARTMENT IMMEDIATELY.
      2. Do not use the Site, a contact form or any other online feature to report an emergency or an urgent medical concern. Communications submitted through the Site are not monitored continuously.
      3. If you have an urgent but non-emergency concern, please call the Practice at (423) 528-8833 during business hours.
  • Eligibility; Minors
      1. The Site is intended for use by individuals who are 18 years of age or older.
      2. A parent or legal guardian may use the Site on behalf of a minor. By doing so, that adult represents that he or she is the minor’s parent or legal guardian and is authorized to act on the minor’s behalf, and agrees to these Terms both individually and on the minor’s behalf. Minors under 18 should not use the Site except through a parent or legal guardian.
      3. The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13 through the Site. We do treat patients under 18, and a parent or legal guardian may submit information about a minor patient through the Site; information we receive about a minor patient in connection with care is protected health information governed by our Notice of Privacy Practices. If you believe a child has provided us information through the Site, please contact us using the information in Section 15.
  • Acceptable Use
    1. You agree that you will not:
      • Use the Site for any unlawful purpose or in violation of these Terms;
      • attempt to gain unauthorized access to the Site, any account, or any system or network connected to the Site, or probe, scan, or test the vulnerability of any of them;
      • interfere with or disrupt the Site, or introduce any virus, malware, or other harmful code;
      • use any robot, spider, scraper, or other automated means to access, harvest, or extract content or data from the Site;
      • copy, reproduce, distribute, republish, modify, or create derivative works from Site content except as expressly permitted by Section 8;
      • impersonate any person or entity, or misrepresent your affiliation with any person or entity;
      • submit information that is false, misleading, or that you are not authorized to submit; or
      • use the Site in any manner that could damage, disable, overburden, or impair it, or interfere with any other party’s use of it.
    2. We may suspend or terminate your access to the Site or any account at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to the Practice, its patients, or others. Suspension or termination of your access to the Site or any account does not affect your right of access to your medical records under applicable law, and does not terminate or alter any physician-patient relationship or any obligation of the Practice with respect to your care. If your access to the Site is suspended or terminated, you may obtain your records and communicate with the Practice using the contact information in Section 15.
  • Online Features
      1. Accuracy of information.  You agree that the information you submit through the Site, including contact and appointment-request information, is accurate and complete to the best of your knowledge, and that you will update it as needed.
      2. Not for urgent needs.  Messages and forms submitted through the Site are not monitored continuously and must not be used for emergencies or urgent medical concerns. See Section 3.
      3. Communications through the Site; please do not send health information.  Communications you send through the Site, including ordinary email, are not necessarily secure and may not be encrypted in transit. Please do not include diagnoses, symptoms, photographs of a medical condition, test results, or other detailed health information in a contact form or unencrypted email. Send only the information we need in order to contact you. All protected health information nonetheless submitted is handled in accordance with our Notice of Privacy Practices and applicable law.
      4. Appointment requests.  An appointment request submitted through the Site is a request only. It is not scheduled or confirmed until the Practice confirms it by telephone or by email.
      5. 6. If you wish to know if a provider has a license in the state in which services are anticipated, please call the office at 423-528-8833 in advance of the appointment.
  • Third-Party Websites and Services
      1. The Site may contain links to, or integrations with, third-party websites and services, which may include a payment processor, a laboratory, a pharmacy, and general health information resources. We do not control those third parties and are not responsible for their content, products, services, or privacy or security practices.
      2. A link or integration is not an endorsement. Your use of any third-party website or service is governed by that party’s own terms and privacy policy, and we encourage you to review them.
  • Intellectual Property
      1. The Site and its contents, including text, graphics, photographs, illustrations, logos, page layout, and design, are owned by the Practice or its licensors and are protected by copyright, trademark, and other laws.
      2. We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your personal, non-commercial use. Any other use, including reproduction, distribution, modification, public display, or the creation of derivative works, is prohibited without our prior written consent.
      3. SkinWise, PLLC, SkinWise Dermatology, and the Practice’s logo are marks of the Practice and may not be used without our prior written permission.
  • Privacy; Relationship to Our Notice of Privacy Practices
      1. Our collection and use of information through the Site is described in our Privacy Policy, available at https://skinwisedermatology.com/privacypolicy.
      2. These Terms and the Privacy Policy do not govern protected health information. Protected health information, including information you submit through the Site that constitutes protected health information and information created or maintained in connection with the health care services we provide is governed by our Notice of Privacy Practices, available upon request, which describes your rights and our obligations under the Health Insurance Portability and Accountability Act (“HIPAA”) and applicable state law.
      3. Order of precedence.  To the extent of any conflict among these documents: (a) as to protected health information, the Notice of Privacy Practices controls; (b) as to information collected through the Site that is not protected health information, the Privacy Policy controls; and (c) as to all other matters relating to your use of the Site, these Terms control.
      4. Cookies, analytics, and tracking technologies.  The Site may use cookies, pixels, and similar technologies, including those provided by a third-party website analytics provider, to operate the Site and to understand how it is used. We do not use third-party advertising technologies on the Site, and the analytics technologies we do use are configured not to collect or transmit protected health information. We review the Site’s tracking technologies periodically for consistency with this Section. Those technologies, and your choices with respect to them, including browser cookie controls, are described in the Privacy Policy. We do not currently respond to “Do Not Track” signals or similar mechanisms transmitted by web browsers, because no common industry standard for responding to those signals has been adopted.
      5. Marketing and communications.  We may contact you about the Practice, including responses to your inquiries, appointment reminders and other appointment-related messages, information about treatment alternatives, and general practice announcements that do not use your health information. Marketing that uses your health information requires your written authorization as described in our Notice of Privacy Practices, and you may opt out of marketing emails at any time by following the unsubscribe instructions in those messages.

      1. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEITHER THE PRACTICE NOR ITS OWNERS, EMPLOYEES, OR AGENTS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE OR ITS CONTENT.
      2. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).
      3. Scope; professional services excluded.  This Section applies only to claims arising out of your access to or use of the Site and its content. 4. Some jurisdictions do not permit the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
  • Indemnification
      1. You agree to indemnify, defend, and hold harmless the Practice and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or relating to (a) your breach of these Terms, (b) your misuse of the Site, (c) your violation of any law or of the rights of any third party in connection with your use of the Site, or (d) any content or information you submit through the Site.
      2. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense. • General Provisions
    1. Severability.  If any provision of these Terms is held invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable or, if modification is not possible, severed, and the remaining provisions will remain in full force and effect. Entire agreement.  These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Practice with respect to the Site, and supersede any prior understanding with respect to the Site. 6. Survival.  Sections 2, 3, 8, 9, 10, 11, 12, 14, and 17 survive any termination of your access to the Site.
